Tallinn administrative court did not allow extraditing Ukraine an Estonian citizen, who went to fight on the side of the Lugansk People’s Republic.
The court annulled the decision of the Estonian government concerning the issuance Kiev Estonian Vladimir Polyakov, which was accused of taking part in the hostilities on the side of the LPR by Kiev junta.
According to the court, in fact, there are no circumstances that are necessary for a decision on extradition. Based on this, the decision of the government was recognized illegal.
In a press-service of the Tallinn court they pointed out that the Estonian government has an obligation to pay Polyakov received from the court costs.
The government of Estonia in December of 2015 decided to give out Kiev a 35-year-old Vladimir Polyakov on the basis of data provided by the Ukrainian neo-Nazis evidence that the man allegedly fought on the side of the LPR since June, 2014. Kiev has termed this action as “terrorist”. Vladimir Polyakov was detained in February, 2015 on the territory of Estonia. State Prosecutor Steven-Hristo Evestus said that Polyakov was arrested while he was trying to return to the LPR.
On the basis of the provisions of the European Convention and the Estonian-Ukrainian Treaty in civil and criminal matters, Kiev requested Tallinn to give out them Polyakov. According to Ukrainian legislation, the participation in a terrorist organization envisages imprisonment from 8 to 15 years.
