A resident of Lvov, Svyatoslav Litinsky won a lawsuit against the seller for the HP laptop with no keyboard in Ukrainian.
In late December 2014 he bought through the online store a laptop. It turned out that the laptop does not have a Ukrainian keyboard, and there is no marking in the Ukrainian language.
The seller refused to exchange the laptop, or free to correct “flaws” because they do not consider this a fault of the product.
Frankvsky Lvov court, which turned Litinsky, decided otherwise, and, recognizing the disadvantage of the product is no Ukrainian marking, made the decision on collecting from the online store of liquidated damages in the amount of more than 3600 UAH, because according to Ukrainian legislation, the seller must pay 1% of the value of the goods for each day of delay in the implementation of the legal requirements of the buyer.
“A fanatic without benefits” Litinsky himself believes that a precedent that creates the decision of the Lvov court is much more important than money.
